Il permet aux salari\u00e9s d\u2019\u00e9pargner pour leur retraite avec l\u2019aide de leur entreprise.<\/p>\n<blockquote><p>A partir du 1er octobre 2020, l&#039;ouverture du PERCO est impossible<\/p><\/blockquote>\n<p>En 2019, la loi PACTE a cr\u00e9\u00e9 trois nouveaux plans d&#039;\u00e9pargne retraite : le PER individuel (PERIN), le PER collectif (PERECO) et le PER obligatoire (PERO). Ils cohabitent avec des syst\u00e8mes de retraite plus anciens (PERCO, Madelin, Article 83, PERP\u2026).<\/p>\n<p>Toutefois, les versements au titre d\u2019anciens contrats de retraite restent possibles ; ils peuvent \u00e9galement \u00eatre convertis ou transf\u00e9r\u00e9s vers de nouveaux PER.<\/p>\n<p>Les PERCO ouverts avant le 1er octobre 2020 subsistent et pourront accueillir de nouveaux adh\u00e9rents apr\u00e8s cette date ou pourront \u00eatre transf\u00e9r\u00e9s au PERE.<\/p>\n<p><strong>PERCO ou PERCOL ?<\/strong><\/p>\n<p>Le PERCO pourrait prendre la forme d&#039;un plan de retraite collectif au sein de l&#039;entreprise (PERCOI), qui a \u00e9galement \u00e9t\u00e9 cl\u00f4tur\u00e9 \u00e0 la vente le 1er octobre 2020. Comme pour le PEE, les sommes vers\u00e9es au PERCO sont investies sur les march\u00e9s financiers et destin\u00e9es \u00e0 l&#039;\u00e9pargne salariale.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"%d0%9a%d0%b0%d0%ba_%d0%bf%d0%be%d0%bf%d0%be%d0%bb%d0%bd%d1%8f%d1%82%d1%8c_perco\"><\/span>Comment recharger PERCO ?<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>Aucun paiement n&#039;est requis. Le PERCO peut \u00eatre r\u00e9approvisionn\u00e9 avec :<\/p>\n<ul>\n<li>Montants issus de la participation aux b\u00e9n\u00e9fices et des participations ou transferts d\u2019autres plans d\u2019\u00e9pargne salariale.<\/li>\n<li>Droits inscrits sur un compte d&#039;\u00e9pargne (CET).<\/li>\n<li>A d\u00e9faut de CET - montants correspondant aux jours de repos non utilis\u00e9s, dans la limite de 10 jours par an.<\/li>\n<li>Paiements volontaires limit\u00e9s.<\/li>\n<li>Paiements suppl\u00e9mentaires de l&#039;entreprise appel\u00e9s cotisations. Ce montant ne peut exc\u00e9der trois fois le montant que le salari\u00e9 a vers\u00e9 sur son PERCO et ne peut exc\u00e9der 16% du plafond annuel de la S\u00e9curit\u00e9 sociale, soit 6 581,76 \u20ac en 2022.<\/li>\n<\/ul>\n<p>Le PERCOI se r\u00e9approvisionne de la m\u00eame mani\u00e8re que le PERCO.<\/p>\n<blockquote><p>Si le B\u00c9N\u00c9FICIAIRE ne demande pas le paiement imm\u00e9diat de sa prime de participation et ne se prononce pas sur l&#039;attribution de ses droits, le 50% de sa participation est automatiquement revers\u00e9 au PERCO.<\/p><\/blockquote>\n<h2><span class=\"ez-toc-section\" id=\"perco_%d0%b2%d1%8b%d0%b2%d0%be%d0%b4_%d1%80%d0%b5%d0%bd%d1%82%d1%8b_%d0%b8%d0%bb%d0%b8_%d0%ba%d0%b0%d0%bf%d0%b8%d1%82%d0%b0%d0%bb%d0%b0\"><\/span>PERCO : retrait de loyer ou de capital<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>L&#039;objectif du PERCO est d&#039;aider les adh\u00e9rents \u00e0 \u00e9pargner pour leur retraite compl\u00e9mentaire.<\/p>\n<p>La liquidation du PERCO intervient automatiquement \u00e0 compter de la date de liquidation de la pension du d\u00e9posant dans le r\u00e9gime d&#039;assurance vieillesse obligatoire.<\/p>\n<p>Il existe plusieurs options de retrait. Toutefois, l&#039;option s\u00e9lectionn\u00e9e doit appara\u00eetre dans les r\u00e8gles PERCO.<\/p>\n<p>La r\u00e8gle de base du PERCO est qu&#039;il verse une rente viag\u00e8re RVTO. Toutefois, les r\u00e8gles PERCO peuvent \u00e9galement pr\u00e9voir des \u00e9missions sous forme de capital, vers\u00e9es sous forme d&#039;une somme forfaitaire ou \u00e9chelonn\u00e9e. Les r\u00e8gles du PERCO pr\u00e9cisent les modalit\u00e9s selon lesquelles le b\u00e9n\u00e9ficiaire peut exercer son \u00e9lection.<\/p>\n<p>Dans certains cas pr\u00e9vus par la loi, les participants pourront \u00e9galement b\u00e9n\u00e9ficier d&#039;un d\u00e9blocage anticip\u00e9 de leur investissement PERCO.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"perco_%d0%b8_%d0%bf%d0%be%d0%b6%d0%b8%d0%b7%d0%bd%d0%b5%d0%bd%d0%bd%d0%b0%d1%8f_%d1%80%d0%b5%d0%bd%d1%82%d0%b0\"><\/span>PERCO et rente viag\u00e8re<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>Un PERCO ne peut pr\u00e9voir une sortie que sous forme de rente viag\u00e8re. A la lib\u00e9ration, la soci\u00e9t\u00e9 de gestion PERCO transf\u00e8re le capital composant la rente \u00e0 l&#039;assureur.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"perco_%e2%80%94_%d0%b2%d1%8b%d0%b2%d0%be%d0%b4_%d0%ba%d0%b0%d0%bf%d0%b8%d1%82%d0%b0%d0%bb%d0%b0\"><\/span>PERCO - retrait de capital<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>Si les r\u00e8gles PERCO le pr\u00e9voient, l&#039;investisseur peut restituer son \u00e9pargne sous forme de capital. Les cas de lib\u00e9ration anticip\u00e9e comprennent, par exemple\u00a0:<\/p>\n<ul>\n<li>d\u00e9c\u00e8s du salari\u00e9, de son conjoint ou d&#039;une personne associ\u00e9e au salari\u00e9 par le biais du syst\u00e8me PACS ;<\/li>\n<li>handicap de cat\u00e9gorie 2-3 du salari\u00e9, du conjoint ou des enfants ;<\/li>\n<li>expiration du droit aux allocations de ch\u00f4mage ;<\/li>\n<li>situation de surendettement ;<\/li>\n<li>acquisition d&#039;une r\u00e9sidence principale ou restauration d&#039;une r\u00e9sidence principale endommag\u00e9e suite \u00e0 un sinistre reconnu par une r\u00e9solution interminist\u00e9rielle.<\/li>\n<\/ul>\n<h2><span class=\"ez-toc-section\" id=\"%d0%9f%d0%be%d1%82%d0%be%d0%bb%d0%be%d0%ba_perco\"><\/span>Plafond PERCO<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>La p\u00e9riodicit\u00e9 des versements est libre, seul le montant annuel des versements est limit\u00e9.<\/p>\n<p>Les dispositions du plan peuvent exiger un versement annuel minimum (maximum 160 \u20ac).<\/p>\n<p>En raison de l\u2019interdiction de toute discrimination, chaque salari\u00e9 doit avoir la possibilit\u00e9 de choisir entre toutes les options d\u2019investissement propos\u00e9es, s\u2019il en existe plusieurs. Il est donc impossible de pr\u00e9voir des formules de placement diff\u00e9rentes pour diff\u00e9rentes cat\u00e9gories de salari\u00e9s.<\/p>\n<p>Les sommes vers\u00e9es au PERCO ne peuvent exc\u00e9der 1\/4 (25%) du revenu annuel imposable de l&#039;ann\u00e9e pr\u00e9c\u00e9dente ni m\u00eame la r\u00e9mun\u00e9ration de retraite ou de pr\u00e9retraite de l&#039;adh\u00e9rent.<\/p>\n<p>Ce plafond 25% s&#039;applique au m\u00eame exercice, quelle que soit la date de versement des sommes, ainsi qu&#039;\u00e0 tous les r\u00e9gimes en cas de r\u00e9gimes multiples.<\/p>\n<p>En cas de participation simultan\u00e9e \u00e0 plusieurs plans d&#039;\u00e9pargne collectifs, le plafond est fix\u00e9 pour les versements effectu\u00e9s au titre de tous ces plans.<\/p>\n<p>Ce plafond 25% s&#039;applique au m\u00eame exercice, quelle que soit la date de versement des sommes, ainsi qu&#039;\u00e0 tous les r\u00e9gimes en cas de r\u00e9gimes multiples.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"%d0%92%d0%ba%d0%bb%d0%b0%d0%b4_%d0%ba%d0%be%d0%bc%d0%bf%d0%b0%d0%bd%d0%b8%d0%b8\"><\/span>Cotisation de l&#039;entreprise<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>La contribution de l&#039;entreprise est un \u00e9l\u00e9ment obligatoire du r\u00e9gime. Ce versement peut atteindre 2% du PASS, soit 822,72 euros pour 2022 (822,72 euros pour 2021 et 2020 ; 810 euros pour 2019). Ce r\u00e9approvisionnement est appel\u00e9 \u00ab r\u00e9approvisionnement \u00bb.<\/p>\n<p>Ce paiement s&#039;applique uniquement aux r\u00e9gimes lanc\u00e9s \u00e0 compter du 4 d\u00e9cembre 2008.<\/p>\n<p>L&#039;employeur a \u00e9galement la possibilit\u00e9 d&#039;effectuer des versements p\u00e9riodiques \u00e0 compter du 8 ao\u00fbt 2015, sous r\u00e9serve que cela soit pr\u00e9vu par la r\u00e9glementation et sous r\u00e9serve d&#039;une r\u00e9partition uniforme pour l&#039;ensemble des salari\u00e9s.<\/p>\n<p>Le traitement fiscal et social des sommes vers\u00e9es sera le m\u00eame que celui de l\u2019acompte.<\/p>\n<p>Ces versements peuvent aller jusqu&#039;\u00e0 2% depuis PASS soit 822,72 euros en 2022 et comptent dans le plafond de 16% appliqu\u00e9 aux recharges.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"%d0%9f%d0%be%d0%bf%d0%be%d0%bb%d0%bd%d0%b5%d0%bd%d0%b8%d0%b5\"><\/span>R\u00e9approvisionnement<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>Les versements de l&#039;entreprise peuvent \u00e9galement prendre la forme de versements compl\u00e9mentaires aux b\u00e9n\u00e9ficiaires, il s&#039;agit de la contribution de l&#039;employeur. Le montant vers\u00e9 par le titulaire du PER (et probablement soumis \u00e0 cotisation) est limit\u00e9 \u00e0 \u00bc (25%) du salaire annuel brut du salari\u00e9.<\/p>\n<p>La cotisation patronale apr\u00e8s versement aux salari\u00e9s doit respecter le double plafond :<\/p>\n<ul>\n<li>La contribution patronale d\u00e9fiscalis\u00e9e au PERCO en compl\u00e9ment des avantages sociaux est plafonn\u00e9e annuellement \u00e0 16% du PASS, soit 6 582 \u20ac pour 2022 (6 582 \u20ac en 2021 et 2020 ; 6 484 \u20ac en 2019, 6 357 \u20ac en 2018, 3 276 \u20ac en 2017 et 6 179 euros en 2016). Ce plafond peut \u00eatre cumul\u00e9 avec le plafond applicable au PEE si le salari\u00e9 b\u00e9n\u00e9ficie \u00e0 la fois de PEE ou de PEI et de PERCO.<\/li>\n<li>Le montant de la cotisation ne doit pas d\u00e9passer trois fois le salaire du salari\u00e9. Si cette derni\u00e8re dispose de plusieurs r\u00e9gimes compl\u00e9t\u00e9s par plusieurs entreprises, elle doit cumuler toutes les sommes vers\u00e9es pour \u00e9valuer chacun des plafonds propres au PEE, au PEI et au PERCO.<\/li>\n<\/ul>\n<h2><span class=\"ez-toc-section\" id=\"%d0%9f%d0%b5%d1%80%d0%b5%d0%b2%d0%be%d0%b4_perco\"><\/span>Traduction de PERCO<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Les transferts du PERCO vers le PEE ne sont pas autoris\u00e9s (seuls les transferts du PEE vers le PERCO sont autoris\u00e9s). Ainsi, en cas de rupture du contrat de travail, s&#039;il n&#039;existe pas de PERCO chez le nouvel employeur, le salari\u00e9 conserve le PERCO de son ancien employeur.<\/p>\n<p>Avant le 1er octobre 2020, un PERCO ne pouvait \u00eatre transf\u00e9r\u00e9 que sur un autre PERCO, qu&#039;il y ait ou non rupture du contrat de travail. A partir du 1er octobre, le PERCO est transf\u00e9rable en PER ou PERE : il n&#039;est plus possible de transf\u00e9rer un PERCO vers un autre PERCO.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"%d0%9f%d0%b5%d1%80%d0%b5%d0%b2%d0%be%d0%b4_%d0%bd%d0%b0_per_%d0%b2_%d1%81%d0%be%d0%be%d1%82%d0%b2%d0%b5%d1%82%d1%81%d1%82%d0%b2%d0%b8%d0%b8_%d1%81_%d0%b7%d0%b0%d0%ba%d0%be%d0%bd%d0%be%d0%bc_pacte_%d1%81_1_%d0%be%d0%ba%d1%82%d1%8f%d0%b1%d1%80%d1%8f_2019_%d0%b3\"><\/span>Virement au PER conform\u00e9ment \u00e0 la loi PACTE (\u00e0 compter du 1er octobre 2019)<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>Il est possible de transf\u00e9rer les droits \u00e9tablis au titre des anciens contrats d&#039;\u00e9pargne retraite (Perp, Madelin, article 83, etc.) vers un PER (particulier ou PERE). Les PERCO peuvent \u00eatre convertis en PER (\u00e9ventuellement PER individuel, PERE collectif, PERE obligatoire). Le transfert s&#039;applique \u00e0 tous les montants disponibles en PERCO (sans distinction de leur origine : participation, participation, cotisations, versements volontaires) : ces montants incluent une partie des versements issus de l&#039;\u00e9pargne salariale.<\/p>\n<p>Le gestionnaire du plan d&#039;origine communique au nouveau gestionnaire les qualifications des paiements (volontaires, obligatoires, etc.) pour les acheminer vers les diff\u00e9rentes parties du PER et d\u00e9terminer la fiscalit\u00e9 en aval.<\/p>\n<p>Par ailleurs, le nouveau dirigeant a l&#039;obligation d&#039;informer le titulaire du plan avant le transfert : il doit l&#039;informer des caract\u00e9ristiques du PER individuel et des diff\u00e9rences entre l&#039;ancien et le
