Quel est son but? Cr\u00e9er un environnement juridique, fiscal et social plus simple et plus s\u00e9curis\u00e9. Voyons ce qui va changer.<\/p>\n<p>Comme argument en faveur de l&#039;exercice d&#039;activit\u00e9s professionnelles ind\u00e9pendantes, la loi pr\u00e9voit la cr\u00e9ation d&#039;un statut unique d&#039;entrepreneur individuel, qui devrait assurer une protection plus efficace des biens personnels des entrepreneurs. Ainsi, le statut d&#039;entrepreneur individuel \u00e0 responsabilit\u00e9 limit\u00e9e (EIRL) est supprim\u00e9 et ses principaux avantages sont consolid\u00e9s dans le nouveau statut.<\/p>\n<p>Les entrepreneurs individuels ont \u00e9galement la possibilit\u00e9 de d\u00e9velopper plus facilement leur entreprise, en passant du statut d&#039;entrepreneur individuel \u00e0 la cr\u00e9ation d&#039;une entreprise.<\/p>\n<p>D\u00e9sormais, tous les biens personnels d&#039;un entrepreneur individuel deviennent par d\u00e9faut intouchables pour les cr\u00e9anciers professionnels, \u00e0 moins qu&#039;il n&#039;en d\u00e9cide lui-m\u00eame autrement. Seuls les objets utiles aux activit\u00e9s professionnelles d&#039;un entrepreneur individuel, comme par exemple un ordinateur ou un v\u00e9hicule, peuvent \u00eatre saisis en cas de dettes. Le partage des biens s&#039;effectuera automatiquement, sans n\u00e9cessiter aucune d\u00e9marche administrative de la part du cr\u00e9ancier.<\/p>\n<p>A noter que la r\u00e9forme s&#039;appliquera \u00e0 tous les entrepreneurs trois mois apr\u00e8s l&#039;adoption de la loi. Les professionnels qui voient leur entreprise devenir non viable et d\u00e9cident de la fermer peuvent d\u00e9sormais en profiter pour assouplir leur situation financi\u00e8re tout en cherchant une nouvelle source de revenus (emploi). Selon le gouvernement, environ 30 000 entrepreneurs pourront ainsi b\u00e9n\u00e9ficier de l&#039;ATI chaque ann\u00e9e, contre 1 000 actuellement. Cette prestation de 800 euros par mois, cr\u00e9\u00e9e en 2018, ne s&#039;appliquait jusqu&#039;\u00e0 pr\u00e9sent qu&#039;aux anciens entrepreneurs en cours de r\u00e9organisation ou de liquidation de leur statut professionnel par voie judiciaire. Avec le nouveau statut, le montant sera toujours de 800 euros par mois, sauf pour ceux qui ont eu des revenus plus faibles ces deux derni\u00e8res ann\u00e9es. Ce montant sera fix\u00e9 ult\u00e9rieurement par d\u00e9cret.<\/p>\n<p>Enfin, les arri\u00e9r\u00e9s de cotisations sociales des dirigeants de la plupart des soci\u00e9t\u00e9s anonymes (SARL) peuvent d\u00e9sormais \u00e9galement \u00eatre r\u00e9gl\u00e9s dans le cadre de la proc\u00e9dure de surendettement.<\/p>\n<p>Source:<a
